Proton Mini battery problem question

I have a Proton Mini,  about 2 months old, that has been working fine, until recentlty.  After a charge, the battery bar at the top is solid, and moves down normally, until about 3.85v.  After that the battery bar cycles from low(yellow) to green (left to right) cycle.   This is simular to how it would look normally while charging, but this is happening during regualar (non-charge) use.  If I charge above 3.85v - every thing is normal, but under 3.85v, the battery bar cycles.   I am worried about battery safety - and questioning if one internal battery is weaker than the other.   Should I return the device, or any idea's?  Thank you.
